<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Minutes <br />August 14, 1984 <br /> <br />Page Three <br /> <br />Dana Harris, 1203 Brighton Square, expressed concern for the <br />time limitations on the Covenants and Declarations. <br /> <br />City Attorney indicated the restrictions would be perpetual; <br />however, if all homeowners joined together and amended them. <br />they could be changed; there would be a question of the <br />amount of leverage the city would have regarding amendments <br />to the PRD. <br /> <br />Schmidt asked the attorney to give particular attention to <br />amending a PRD through a Covenants and Declarations amend- <br />ment, and to keep in mind that we are going to have zero lot <br />line developments, townhouse developments, etc. and asked if <br />our current ordinance addresses these situations. <br /> <br />Schmidt stated the council is always pleased when a develop- <br />er and surrounding neighbors work together to air their <br />concerns. <br /> <br />Strangis indicated that Brighton Square would not be asking <br />for a second access, as had beer. indicated previously. <br /> <br />Motion by Harcus, seconded by Blomquist, to close the pUblic <br />hearing. ' <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Motion by Blomquist. seconded by Benke, to WAIVE THE READING <br />AND ADOPT A RESOLUTION APPROVING PRD-41 AND PL-139 SUBJECT <br />TO CONDITIONS. <br /> <br />5 Ayes -0 Nayes. Motion Carried <br /> <br />Krueger reviewed staff report regarding a request for re- <br />zoning a certain property in the City of New Brighton from <br />R-1 (Single Family Residential) to B-3 (General Business). <br /> <br />Robert Lee <br />Rezoning <br />Report 84-210 <br /> <br />James Senden reviewed the project. <br /> <br />Schmidt indicated an expansion of the parking lot would be <br />of benefit to all. <br /> <br />Joe Strang;s, 1235 Brighton Square, had no objections but <br />would like to think the additional parking didn't mean <br />expanding the restaurant. <br /> <br />Blomquist indicated an increase in the size of the rest- <br />aurant would be a non-conformity. <br /> <br />Dana Harris. 1203 Brighton Square. expressed concerns of <br />the current fence, which needs repairing. <br /> <br />Senden indicated the repairs would be made at the time of <br />the expansion. <br />
