<br />1 <br /> <br />I <br /> <br />I <br /> <br />City of New Brighton <br />September 27, 1983 <br />Page Seven <br /> <br />Mayor Harcus stated he was recommending approval of the <br />request because future expansion plans would require <br />redoing the site plan and would create undo hardship for <br />the applicant. <br /> <br />Councilmember Janecek stated she felt it was a difficult <br />site and that it was appropriate to approve this request. <br /> <br />Councilmember Schmidt stated there was a certain element <br />of trust in the applicant's proposed future development <br />of the site and that granting this request would not <br />place hardship on the adjacent property. <br /> <br />5 Ayes - 0 Nayes - motion carried <br /> <br />The Director of Community Development reviewed the <br />staff report regarding the sale of Lots 15 and 18, <br />Block I, Redmond Addition to David Ficek. <br /> <br />Motion by Blomquist, seconded by Schmidt to authorize <br />the Mayor and Acting City Manager to execute a <br />purchase agreement with David E. Ficek for the purchase <br />of Lots 15 and l8, Block 1, Redmond Addition, with <br />the following amendments: <br /> <br />I. That the third contingency be amended to read "Seller <br />warrants that the property is zoned R-I, Single Family <br />Residential as the date of closing." <br /> <br />2. That the Seller agreed to deliver a quit claim, versus <br />warranty, deed. <br /> <br />5 Ayes - 0 Nayes - motion carried <br /> <br />The Finance Director had no comments to add to the <br />staff report. <br /> <br />Motion by Harcus, seconded by Benke to waive the reading <br />and adopt a RESOLUTION AUTHORIZING PAYMENT OF GOLF <br />COURSE ASSESSMENT. <br /> <br />5 Ayes - 0 Nayes - motion carried <br /> <br />The City planner reviewed the staff report regarding the <br />request from the Planning Commission to have the Council <br />direct staff to notify the Metropolitan Council in <br />writing that the Waste Energy Systems Incinerator pro- <br />posed by Midwest Asphalt for a site in the City of New <br />Brighton is inconsistent with the City's comprehensive <br />Plan contrary to what was stated in Section 12 (b) of the <br />submitted environmental assessment. <br /> <br />Motion by Schmidt, seconded by Janecek to direct staff to <br /> <br />Purchase <br />Agreement-City <br />Owned Lots - <br />Report #83-248 <br />David Ficek <br /> <br />RESOLUTION <br />AUTHORIZING <br />PAYMENT OF GOLF <br />COURSE ASSMT. <br />Report #83-250 <br />RESOLUTION # <br />83-109 <br /> <br />Request to <br />Draft Letter <br />Midwest Asphalt <br />Report #83-258 <br />
