The City's authority to conduct such background checks is subject to any requirements in state law relating to background checks for specific types of applicants. (Ord.# 705 3/25/03) Sees. 21-26--21-34. Resenred. Article 2. Compensation Plan Sec. 21-35. Adoption of the Plan. The City Council shall adopt a compensation plan annually. The plan shall provide that all positions have a designated pay range. The City Council shall amend the Plan annually by resolution upon receipt of recommendations from the City Manager. In making such recommendations, the City Manager shall give consideration to the following factors: (I) Maintenance of equitable relationships between positions based on their relative duties and responsibilities. (2) The general level of rates in the appropriate labor markets for comparable work under similar conditions. (3) Current recruitment and retention experience. Sees. 21-36--21-53. Resenred. Article 3. Employee Benefits Sec. 21-54.1. Eligible Employees. (1) Regular and probationary regular employees are eligible for the benefits listed in Sections 21. 54.2 through 21-68. These benefits are offered to employees at the time ofthe passage of this Chapter. These benefits may be changed, amended, clarified, altered, or rescinded by the City at any time. (2) Effective January 1, 2000, regular part-time employees are eligible for the benefits listed in Sections 21-54.2, 21-56, and 21-64-67. Regular part-time employees shall be credited with years of service in an eligible position to determine their accrual rate. Sec. 21-54.2. Holidays. (1) The following holidays will be observed as paid holidays: A. New Year's Day, January I. B. Martin Luther King Day, the third Monday in January. C. President's Day, the third Monday in February.
