II If the <br />employee has no accrued sick leave remaining after <br />sixty-five (65) days of absence due to inji:l,ryon <br />duty, he shall receive no further compens.ation from <br />the village, during the duration of such absence. <br /> <br />Subd. 4. Eligibility Determined Valid After Five Working <br />Days of Absence and Employee Has Accrued Sick Leave Remaining. <br />In those cases where eligibility for workmens compensation has not <br />been determined valid until after five (5) working days of absence <br />and where suchemploy,ee has accrued sick leave ;remaining ,,~:the"c <br />employee shall use accrued sick leave according to the provisions. <br />of Section 240:~0, until such time such employee is determined <br />eligible. When determined eligible injured on dutyoenefits shall <br />be calculated as follows: <br /> <br /> <br />a. From the day that eligibility has been determined <br />valid, injured on duty benefits shall be in accordance <br />with Section 240:31, Subd. 3, for the remainder of <br />the sixty day coverage period. <br /> <br />b. For all working days after the first five (5) to the <br />date of ,elig.ibility determination sick leave shall be <br />reinstated in an,>amount equal to the sick leave use <br />percentage multiplied by the number of sick leave <br />days utilized after the first five (5) days. In no <br />case shall more sick leave time be reinstated than <br />sixty (60) days multiplied by the sick leave use <br />percentage. <br /> <br /> <br />Subd. 5. Eligibility Determined Valid After Five Working <br />Days of Absence and Employee has Depleted Sick Leave prior to an <br />Eligibility Determination. In those cases where eligibility for <br />orkmens compensation has not been determined valid until after <br />five (5) working days of absence and where such employee has <br />depleted all sick leave prior to an eligibility determination, an <br />employee shall use accrued sick leave according to the provisions <br />of Section 240:30, until such time that all sick leave is <br />depleted and thereafter shall receive no further village benefit <br />ntil eligibility is determined valid. 'When determined eligible <br />injured on duty benefits shall be calculated as follows: <br /> <br /> <br />a.
